Joy developed this Privacy Statement to inform you of our privacy practices with respect to information collected on our website, the Octopus app, the Octopus watch, and the device on which you have installed our app.

This Privacy Policy describes how and when JOY collects, uses, and shares your information when you use our services. JOY receives your information through our mobile applications, websites, email notifications, and other interactions with our Services.


Your privacy is very important to us. At JOY, we want to make your experience satisfying and safe. This privacy statement discloses the information we/our partners/ advertising companies gather and how the information is used. At JOY, we never sell your personal information to third parties."Personal Information" is information that identifies a particular individual. If we combine any other information (i.e., information that does not, on its own, identify an individual) with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.

We may use uploaded activity data in an anonymous and aggregated manner that would not personally identify you or your child for purposes of enhancing the quality of our products and applications.

When using any of our Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. Irrespective of which country you reside in or supply information from, you authorize JOY to use your information in the United States and any other country where JOY operates.

We use Personal Information for purposes of allowing you to provide or update your account or profile information and to manage your child's events, alerts and eventually rewards. We also may use your Personal Information to authenticate you (i.e., to establish that you are authorized to access your account); to communicate with you about your account or transactions with us; to provide you with information about our products and applications; to provide you with customer and product support; and, where consistent with applicable laws and the choices available to you, to send you offers and promotions for our products and applications. We may use Personal Information for enhancing the quality of our products and applications; for internal statistical, marketing or operational purposes, including generating sales reports and measuring and understanding demographic, user interest, purchasing and other trends among our customers, and for any other purposes for which we notify you specifically at the time of collection, or as otherwise described in this Privacy Statement, or as permitted or required by law or other legal process.

Please note we may use and disclose information that is not Personal Information for any purpose, except where we are prohibited from doing so under applicable law.

We are not in the business of selling the Personal Information, and we will share Personal Information with others only as described in this Policy Statement.


When you create a JOY account, you must provide access credentials either in the form of an email address and password or by authentication using another service, such as your phone number. You may optionally provide us with additional profile information, including a short bio, location, and profile picture. If you create your JOY account by connecting through another service, we may use public information from that connected account to help complete your JOY profile. You may update or modify your profile information and contact information at any time. Profile information is not available publicly on our Services.

If you invite another guardian to use the Octopus app, you will provide us the name and email address of the second guardian. We use that information for the purpose of sending the second guardian an invitation to download the Octopus app. The second guardian will have an opportunity to review this Privacy Statement before providing us with any additional information.


In addition to using your contact information to create your account, we may use this information to send you information about our Services, respond to your requests and facilitate your use of the Services.


Like many websites, we use "cookie" technology to collect additional website usage data and to improve our Services. A cookie is a small data file that is transferred to your computer's hard disk. JOY may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. If you do not want cookies from JOY or other websites, you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some Services may not function properly if you disable cookies.


Our servers automatically record information ("Log Data") created by your use of the Services. Log Data may include information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie information. We receive Log Data when you interact with our Services, for example, when you visit our websites, sign into our Services,view videos hosted by JOY, or interact with our email notifications. JOY uses Log Data to provide our Services and to measure, customize, and improve them. If not already done earlier, we will either delete Log Data or remove any common account identifiers, such as your username, full IP address, or email address, after 18 months.


JOY uses a variety of third-party services to help provide our Services, including to host our various blogs and wikis and to help us understand the use of our Services. These third-party service providers may use cookies and other technologies to collect information about your use of our Services and other websites and services, including your IP address, device ID, pages viewed, and links clicked. Our service providers include Google Analytics and its demographics and interests reporting feature, which you can opt out of here and here.


We may track user traffic patterns throughout all of our websites or apps. However, we do not correlate this information with data about individual users. We track and catalog the search terms that a user enters in our Search function in our apps and websites, but this tracking is not associated with individual users. We use tracking information to determine which areas of our sites or apps users like and don’t like based on traffic to those areas. This helps us continue to build apps and websites for you.


We engage service providers to perform functions and provide services to us in the United States and abroad. We may share your private personal information with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions.


Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect JOY’s rights or property. In the event that JOY is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.


We may share your non-private, aggregated or otherwise non-personal information.


If you are a registered user of our Services, we provide you with tools and account settings to access or modify the profile information you provided to us and associated with your account. You can also permanently delete your JOY account by contacting us.


Our Services are not directed to persons under 13 (thirteen). If you become aware that your child has provided us with personal information without your consent, please contact us. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child's account.

Our Octopus app is not directed to individuals under the age of 13, and individuals under 13 are prohibited from downloading our app. Although our Octopus watch is designed to be worn by a child, our licensee with respect to the app is the parent/guardian who has downloaded the Octopus app and who uses the Octopus app to sync the data from the Octopus Watch to the parent's/guardian's account. Parents (or Guardians) must register Octopus Watch and download the Octopus app to support their use of the app, as well as any use of the device or app by their child. We recognize the importance of protecting children's Personal Information, and strongly encourage parents and guardians to be actively involved in their children's online activities.
